RE: FILE NO. CE-20-546: APPEAL FOR EXECUTIVE DETERMINATION AUTHORIZING LITIGATION
On February 23rd 2021, you issued an Executive Determination Authorizing Litigation as a penalty for violation of Section 5 of Ordinance No. 18-02, which prohibits rubbish accumulation. I hereby bring this appeal in accordance with Section 6.5 of Ordinance No. 18-02.
I would like you to reverse the determination you made against me. My neighbors complained about my violation to the Department. When I was issued with the Notice of Violation on December 4th 2020, I could not afford to correct the violation by buying a dumpster where I can put rubbish. I am a single mother of three children. My last born has a disability. I run a small business which helps me pay my bills and take care of my children.
However, I have managed to buy a dumpster worth $3,050 and correct the violation. I have fully complied with Section 5 of Ordinance No. 18-02. There is no rubbish on and around my property. For that reason, I believe there is no need to authorize litigation against me. Litigation should be a last resort when all options have been exhausted. Since I’m in compliance with Section 5 of Ordinance No. 18-02, the subject matter has been resolved, therefore there is no need to authorize the El Paso County Attorney’s Office to pursue litigation against me.
Reasons wherefore, I pray that you reverse the executive determination authorizing litigation against me.
