SERVICE CONTRACT
This Agreement is made on __________ between _____________________
(hereinafter referred to as the “Company”) and _____________________
(hereinafter referred to as the “Client”). Together referred to as the “parties”.
WHEREAS the parties herein have willingly agreed to be bound by the following
terms; –
1. Services.
The parties agree that the Company shall provide makeup services at a fee to be
paid by the Client.
2. Payments.
The parties herein agree that the client shall pay a deposit of 15% of the quoted
price to book and save an appointment through electronic transfer only provided by
email.
The service prices will be outlined when the final quote has been given.
Parties agree that the travel fees are variable with a fixed cost of $0.50/km to
location and return.
The final payments will be paid to the company by the client through cash or
electronic transfer after the service has been fulfilled.
3. Date, Time, and Location.
The parties herein agree that the date of providing the contracted services shall be
on ___________________ at _____________.
The Client shall provide the location/address for the performance of the services at
their own cost.
4. Indemnity.
The Client agrees to hold harmless and indemnify the Company from any claim or
liabilities arising from this Agreement’s performance. Including but not limited to the
allegations of actual or alleged damage or injury arising from the Client’s use of the
Company’s products.
5. Expenses.
The parties agree that the Client shall be responsible for any expenses incurred by
the Company in providing the necessary services.
6. Confidentiality.
The parties agree and acknowledge that they own valuable trade secrets and
confidential information. The parties agree they will not disclose to any third parties
without the prior written consent of the other party.
The Company acknowledges that it will not use the social media platforms without
the Client’s consent or in any way that will be perceived as being negative or against
the law.
7. Dispute/Conflict Resolution.
If any conflict or dispute occurs during this Agreement, the same shall be negotiated
between the parties amicable. If the same fails, the disagreement or dispute shall be
referred to mediation.
8. Governing Law.
The provisions and performance of this Agreement shall be construed and
interpreted in accordance with the laws of Ontario, Canada.
9. Termination.
The parties agree that the contract can be deemed terminated if either party cancels
within 72 hours before the appointment.
A cancelation fee of half the amount will be applied for clients canceling the
appointment any time after 72 hours before the appointment.
The deposit will be paid back if cancelation is made after 72 hours have passed by
the company to the client.
10. Modification.
Either party to this Agreement may modify the provisions herein by the same
modification being written and signed by both parties.
11. Severability.
Suppose any provision in this Agreement is deemed by a Court of law to be invalid
or unenforceable. The same shall be severed from the Agreement, and the
remaining provisions shall continue to operate in full force and effect.
12. Assignment.
Neither party to this Agreement may assign or transfer its rights and obligations
without the prior written consent of the other party.
13. Entire Agreement.
This Agreement between the parties supersedes any prior negotiations, promises, or
contracts, either written or oral.
