RE: RESPONSE TO DEMAND LETTER
I refer to your letter dated Insert Date in Demand Letter.
I am writing this letter to inform you it’s unfair that you think I have to pay you the amount you requested. This is because I never received services amounting to the sum of $3,174.50. The only service I received from you was the initial consult on December 22nd 2020, which amounted to $345. I have enclosed a cheque for the same. You were to send me an engagement letter.
On December 28th 2020, I received the engagement letter. A check was mailed but never received.
There was no subsequent communication between you and I after the initial consult. When you sent an email requesting increased retainer of $10,000, I never agreed to it. I sent you an email on January 14th 2021 and notified you that I found another attorney to represent me on the matter.
The engagement agreement states that you cannot represent me or work on my case until retainer is received. I never paid retainer of $10,000, so you weren’t supposed to work on my case. I did not give you any instructions to work on my case. I therefore find it unfair that you are asking for compensation for work not done.
In light of the above situation, I’m sorry I won’t be able to pay you the amount of $3,174.50.
