RENTAL AGREEMENT

This Rental Agreement is entered into this _________ day of _______________ 20___, by
and between, ____________________ (“Landlord”) and
_______________________________, “Tenant” for the apartment located at
______________________________, (“Property”).
1. Term.
 The term of the agreement shall be for a month-to-month period.
 After the expiry period of the agreement, it is open for renewal and/or
extension.

2. Rent.
 The tenant will pay the landlord $ _____ as rent for the occupation.
3. Screening.
 The landlord will be using Transunion Smartmove to run tenant screening
which is hereby consented to and agreed upon by the tenant.
 Parties agree that $150 is due as the application fee when the screening is
being run.
4. Deposit.
 Parities agree that a $500 refundable deposit will be paid to the landlord when
the tenant moves in and will be refunded to the tenant when they move out.

5. Indemnity Clause.
 The tenant hereby agrees to indemnify the landlord from any claims, including
those of third parties, arising out of or in any way related to the tenant’s use of
the apartment or the items of personal property provided therein.
 The tenant assumes all risk of injury or other losses relating to recreational
activities and will hold the landlord harmless.

6. Termination.
 Either party can terminate this agreement by issuing the other prior written
notice.
 In case of early termination by the tenant, the tenant shall be liable for all fees
the landlord would have accumulated up to the date of termination.

7. Force Majeure.
 For this agreement, “Force Majeure” means an event that a diligent party
could not have reasonably avoided in the circumstances, which is beyond the
control of a party and includes, but is not limited to, war, riots, civil disorder,
earthquake, storm, flood or adverse weather conditions, strikes, lockouts or
other industrial action, terrorist acts, confiscation or any other action by
government agencies.
 A Party’s failure to fulfill its obligations due to Force Majeure shall not be
considered a breach of this contract, provided that the party has taken all

reasonable precautions, due care, reasonable alternative measures, and
minimal delay to carry out the terms of this contract.

8. No Waiver.
 Failure by either party to enforce any of the terms or conditions of this
agreement shall not be a waiver of their right to enforce the terms and
conditions of this contract.

9. Severability.
 The provisions of this contract are severable. If any provision is held to be
invalid or unenforceable, it shall not affect the validity or enforceability of any
other provision.
10. Entire Contract.
 This contract constitutes the entire contract between the parties. It
supersedes all prior oral or written contracts or understandings between the
parties concerning the subject matter of this contract. Save as may otherwise
be provided in this contract, the terms and conditions set out in this contract
are the only terms on which the Owner is prepared to deal with the Renter.

11. Dispute Resolution Mechanism.
 Any dispute, controversy, or claim arising from or relating to this agreement or
the interpretation, breach, or validity thereof shall be resolved through
negotiation between the parties.
 The dispute shall be referred to mediation if a resolution cannot be obtained.
12. Governing Law.
 This contract shall be governed by and according to the laws of the State of
Texas.
