This letter serves as my formal objection to all of your Title IV services on behalf of my child.
My objection is grounded on 42 U.S.C. 1301 (d) et eq.
The IV-D program is a federally funded program that is subject to the restrictions in all
applicable federal laws. Title 42 U.S.C. 1301 (d) mandates the Child Support Enforcement
Agency to obtain notification from the responsible parent, in Title IV-D Programs. The section
provides in pertinent part that: “Nothing in this act shall be construed as authorizing any federal
official, agent, or representative, in carrying out any of the provisions of this act, to take charge
of any child over the objection of either parents of such child, or of the person standing in loco
parentis to such child.”
Also, the Fourteenth Amendment of the U.S. Constitution prohibits the states from depriving
“any person of life, liberty, or property, without due process of law.” U.S. Const. amend. XIV .
The Fourteenth Amendment also recognizes the right to privacy in private decisions involving
child raising and education.
You placed my child on the Title IV welfare program. I was not notified of your decision to take
charge of my child under the program. It follows; your failure to notify me and obtain my
consent violates 42 U.S.C. 1301 (d). Your decision to provide welfare services without following
my due process rights is also a violation of my constitutional right to privacy.
Also, my children’s needs are being met fully. There is no indication whatsoever, that they need
any government assistance. To begin a Title IV-D Program, you are obligated to determine
whether the child is in need or is risk of being dependent on any welfare assistance. There was
no abandonment, and you provided no evidence on the contrary, before you started the IV-D
services; therefore, there was an invalid assignment of rights.
The foregoing considered, I hereby demand that you immediately cease and desist from
exercising any of your authority, and must close the Title IV case file opened on behalf of my
child, because of an unauthorized assignment of rights. On the alternative, you should provide
strict proof of abandonment, and proof that the children are dependent.
In the event you fail to comply with my demands herein within one week, I will be forced to
institute a legal action against you, and claim damages.
