MEDIA PUBLISHING AGREEMENT
This Media Publishing Agreement is entered into on __________ (hereinafter
“Effective Date”) by and between RISE NOW MEDIA (hereinafter referred to as the
“Publisher”) and ____________ (hereinafter referred to as the “Client”). Together
referred to as “parties.”
WHEREAS the Parties herein agree to be legally bound by the following terms; –
1. Term.
This Agreement shall be from the Effective date mentioned above until the article
has been published.
2. Services.
The parties agree that the Publisher will provide the services of getting the client
featured in FORBES in Argentina, Colombia, and Ecuador as a digital article with
four other young entrepreneurs.
3. Article details.
Parties agree that the client will be featured in the Digital article in Forbes Argentina,
Forbes Ecuador and Forbes Colombia.
The article will be shared with 4 other young people (under 30) (in total there are 5)
leaders who currently already share their message with the world and live from it.
The Publisher will talk about each of these people, their mission, their impact and
their results.
The article will appear on the home page of the above mentioned Forbes for a
minimum of 3 hours.
The article will have the following process: –
i. The Client answers the Forbes form.
ii. In case the Client does not get all the necessary information, they are sent
questions specifically for them.
iii. The article is written.
iv. A draft is sent to the Client in case they want to make changes.
v. The Client approves and others.
vi. The article will be sent to Forbes.
vii. The article will be Published.
viii. All links will be sent to the client.
The whole process would take between two to four weeks.
4. Price and Payment.
Parties agree that the client will pay $500 to the Publisher through PayPal for the
services to be provided herein.
Parties agree that in the event the client does not get published as agreed herein,
the publisher shall give a 90% refund.
5. Governing Law.
The parties herein agree that the provisions of this Agreement shall be governed in
accordance with and governed by the laws of _________________-.
6. Confidentiality.
The parties agree and acknowledge that they will not disclose to any third parties
without the prior written consent of the other party any information that is deemed
confidential by either party.
7. Exclusivity.
The client herein agrees and acknowledges that their content will exclusively be
published by the Publisher and not shared with any other Third Party. The Publisher,
however, has the right to engage other clients in similar contracts.
8. Declaration.
The Publisher herein declares that the services provided to the Client under this
agreement shall be up to standards and shall be obtained through any fraudulent or
illegal means, and the product thereafter shall be delivered in compliance with all the
applicable laws.
9. Dispute Resolution.
If there is a dispute between the parties, the same shall be negotiated between
them, and if it fails, the dispute shall be referred to mediation.
Each party shall bear its costs.
10. Entire Agreement.
This Agreement constitutes the complete Agreement between the parties and
supersedes any prior written or oral agreements or understandings.
11. Severability.
If any provision of this Agreement is deemed invalid or unenforceable by a court of
law, the same shall be severed from the Agreement, and the remaining provision
shall continue in full force and effect.
12. Amendment.
In the event of any amendment or modification, the same shall be agreed upon
between the parties, put into writing, and signed by the parties.
13. Waiver.
The failure of any party to exercise any right or provision of this Agreement shall not
be considered a waiver of any prior or subsequent rights.
