LEASE AGREEMENT.

This Lease (“Lease”) is entered into by the undersigned Parties for the property known as ______________ (hereinafter “Premises”)

LESSEE: Christina Robertson, Contact Info: _________________________________

TERM. 

This Lease shall commence as of 12th March 2021 and shall be active for 24 months from the move-in-date herein. (The “Lease Term”). The date the Lease commences shall be referred to as the “Move-in Date”. Should possession not be available on the Move-In Date, the Lease shall commence as soon as such possession is available. Landlord shall not be liable for any delay in the Move-In date.

THE PREMISE.

The Premise is located at 108 Ashling SE Smyrna, GA 30080.

RENT PAYMENTS, TAXES AND CHARGES. 

Rent payment $793.66, paid through the Lessee’s bank Account ________________, or in cash.

The lease payment must be paid in advance beginning 1st of every month

All utilities shall remain in the Lessee’s name until such a time as the property is sold to the Lessor and there is transfer of title/ownership, the Lessee understands and undertakes to pay for the utilities during the term of the Lease Agreement.

The Lessee shall be responsible for the monthly $300 HOA fee and taxes and/or make groceries deliveries once per week.

PURCHASE OPTION.

Upon the expiry of the Lease Term, the Lessor shall have the option to purchase the property from the Lessee for $145,000. 

LATE FEES.

The Lessor shall pay a late charge of $_____ for each rent payment made more than 3 days after the day it is due. This fees shall be deemed to be rent.

LESSEE’S ACCESS TO THE PREMISES. 

The Lessee may, upon issuance of a 24 hour notice, enter the premises at any time and from time to time, including without limitation:

  1. for the protection or preservation of the Premises
  2. For the purpose of repairing the Premises
  3. To inspect the Premises; or
  4. To exhibit the Premises to prospective or actual purchasers, mortgagees, tenants, workers, or contractors.

INDEMNIFICATION.

The Lessor shall defend, indemnify and hold harmless the Lessee from and against any and all liability, loss, claims, suits, actions, damages, expenses and causes of action arising out of or related to this Lease Agreement for any personal injury, loss of life, and damages to property (1) by reason or as a result of Lessor’s occupancy thereof, or (2) occurring in or about the Premises, and from and against any order, judgments, or decrees which may be entered thereon, whether or not covered by insurance whatsoever, except where such loss or damage arises from Lessee’s willful or grossly negligent conduct.

NO CRIMINAL ACTIVITY OR BEHAVIOR.

The Lessor covenants to comport at all times in a manner that is not criminal (other than traffic citations) during the term of this Lease, including but not limited to using illegal drugs and substances.

ASSIGNMENT; SUBLEASE. 

The Lessee shall have a right to sublet the 2nd bedroom during the Lease term.

DISPUTE RESOLUTION.

In the event of any disputes between the Parties, they shall use mediation to resolve the matter, Rohan Pryce shall be the mutually agreed upon mediator.

GOVERNING LAW.

This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, USA. Exclusive jurisdiction and venue shall be in the State of Georgia, USA.

BY SIGNING THIS RENTAL AGREEMENT, TENANTS AGREE THAT UPON SURRENDER OR ABANDONMENT, AS DEFINED BY THE FLORIDA STATUTES, LANDLORD SHALL NOT BE LIABLE OR RESPONSIBLE FOR STORAGE OR DISPOSITION OF TENANT’S PERSONAL PROPERTY.
