LEASE AGREEMENT
This Rental Agreement (“this Agreement”) is entered on [ENTER DATE] by and between Scott A McConnell of address 310 Shearer Blvd., Cocoa, FL 32922 (“lessor”), and Jared Scarborough of address [ENTER ADDRESS] (“lessee”), (Individually “Party” and Collectively “Parties”).
Now, as consideration for this agreement, lessor agrees to lease to lessee and lessee agrees to lease from lessor for use as commercial property, the premises located at 540 St. johns St., Cocoa, FL 32922 (“the property”).
THEREFORE, in consideration of the mutual promises herein contained, and other good and valuable consideration, it is agreed:
- TERM
- Lessor hereby leases the property to lessee, and lessee hereby leases the same from lessor, for twelve (12) months beginning November 1, 2020 and ending November 1, 2021 (“term”).
- On [ENTER DATE], lessee shall have possession of the property.
- RENT

- Lessee shall pay to lessor a monthly rent of $1500 and taxes of $97.50 per month during the term.
- Lessee shall also pay sales tax at 6.5%.
- SECURITY DEPOSIT
Lessor waives security deposit.
- INSURANCE
- Lessee shall obtain a liability insurance of not less than $1,000,000.
- Lessee shall one or more personal guarantees. Failure to provide a personal guarantee shall be a ground for Lessor’s terminating this Agreement.
- USE
Notwithstanding the forgoing, lessee shall not use the property for the purposes of storing, manufacturing, or selling any explosives, flammables, or other inherently dangerous substance, chemical, thing or device.
- CONDITION OF PREMISES
- Lessee acknowledges that he has examined the property and that said property is in good satisfactory condition.
- Lessee agrees to keep the property and all items in good order and good condition and to immediately pay for costs to repair and/or replace any portion of the property damaged by Lessee, his agents, employees, invitees and visitors as provided by law.
- At the termination of this Agreement, lessee shall leave the property in clean and good condition except for reasonable wear and tear and the property shall be free of all personal property and trash not belonging to lessor.
- UTILITIES
Lessee shall pay all charges for sewer, gas, electricity, telephone and other services and utilities used by Lessee on the property during the term unless otherwise expressly agreed in writing by lessor.
- ENTRY
Lessor shall have the right to enter upon the property at reasonable hours to inspect the same, provided lessor shall not thereby unreasonably interfere with lessee’s business on the property.
- THE PROPERTY’S RULES
Lessee will comply with the rules of the property adopted and altered by lessor from time to time and will cause all of its agents, employees, invitees and visitors to do so; all changes to such rules will be sent by lessor to lessee in writing.
- PARTIAL INVALIDITY
- Nothing contained in this Agreement shall be construed as waiving any of the lessor’s or lessee’s rights under the law.
- If any part of this Agreement shall be in conflict with the law, that part shall be void to the extent that it is in conflict, but shall not invalidate this Agreement nor shall it affect the validity or enforceability of any other provision of this Agreement.
- NO WAIVER
- Lessor’s acceptance of rent with knowledge of any default by lessee or waiver by lessor of any breach of any term of this Agreement shall not constitute a waiver of subsequent breaches.
- Failure to require compliance or to exercise any right shall not be constituted as a waiver by lessor of said term, condition, and/or right, and shall not affect the validity or enforceability of any provision of this Agreement.
- ENTIRE AGREEMENT
This Agreement constitutes the entire Agreement between lessor and lessee. No oral agreements have been entered into, and all modifications or notices shall be in writing to be valid.
- GOVERNING LAW
This Agreement and any dispute or claim arising out of or in connection with its subject matter or formation shall be governed by and construed in accordance with the law of Florida.
- TERMINATION
Subject to Section 4.2 of this Agreement, either party may terminate this Agreement by sending to the other party a notice of termination of no later than thirty (30) days.
