JOINT CUSTODY AND VISITATION AGREEMENT
This Joint Custody and Visitation Agreement (the “Agreement”) dated this _____ day of ___________________, 2021 between:
Vincent Coy of 412 Jefferson St., Malta, IL 60150
(the “Father”)
- AND –
Britney Devers of 711 S. Main St., Sycamore, IL 60178
(the “Mother”)
BACKGROUND:
- Vincent Coy is the Father of Kane Kopka, Kinzleigh Kopka, Karter Kopka, and Kamila Kopka (the “Minor Children”).
- Britney Devers is the Mother of Kane Kopka, Kinzleigh Kopka, Karter Kopka, and Kamila Kopka (the “Minor Children”).
IN CONSIDERATION OF the matters described above and of the mutual benefits and obligations set forth in this Agreement, the Father and the Mother (individually the “Parent” and collectively the “Parents”) agree as follows:
- The Parents shall share joint legal custody of the Minor Children.
- The Mother shall have the Minor Children for half of every month. The Father shall also have the Minor Children for half of every month.
- In consideration of the fact that the Father is not working, he shall remain with the Minor Children every time the Mother goes to work.
- During holidays, each Parent shall have the Minor Children for an equal number of days.
- During any Parenting period, the Parent will be expected to spend as much time as possible with the Minor Children.
- The Parents shall have as much additional Parenting time with the Minor Children as can be agreed upon by the Parents.
- Neither Parent will schedule activities for the Minor Children during the other Parent’s scheduled Parenting time without the other Parent’s prior agreement.
- If the non-custodial Parent fails to arrive at the appointed time and fails to notify the custodial Parent that he or she will be late, then the custodial Parent need wait for only 120 minutes before considering the visitation canceled.
- In the event that a non-custodial Parent is unable to exercise visitation on a given occasion, he or she must notify the custodial Parent at the earliest possible opportunity.
- The custodial Parent must give the non-custodial Parent, as much notice as is possible, if the Minor Children are ill and unable to participate in scheduled time with the other Parent. A doctor’s excuse is required.
- The Parents shall share in the responsibility to make decisions regarding the health, education, and welfare of the Minor Children.
- Each Parent shall notify the other of the name and address of each health practitioner who examines or treats the Minor Children, such notification to be made within 1 day of the commencement of the first such treatment or examination.
- Each Parent is authorized to take any and all actions necessary to protect the health and welfare of the Minor Children, including but not limited to consent to emergency surgical procedures or treatment. The Parent authorizing such emergency treatment must notify the other Parent as soon as possible of the emergency situation and of all procedures or treatment administered to the Minor Children.
- Each Parent will have access to the Minor Children’s school, medical, and dental records and the right to consult with the professionals providing services to the Minor Children.
- Each Parent shall be designated as a person the Minor Children’s school is to contact in the event of an emergency.
- Each Parent shall keep the other advised at all times of his/her current residence address, telephone numbers (home and work), the Minor Children’s school, and the location of any place where the Minor Children will be spending any extended period of time four days or longer. Neither Parent may use such information for the purpose of harassing, annoying or disturbing the peace of the other or invading the other’s privacy.
- The Parent intending to move the Minor Children must notify the other Parent 60 days prior to any planned change in residence of the Minor Children. The notification must state, to the extent known, the planned address of the Minor Children, including the county and state of the new residence. The notification must be sent by certified mail, return receipt requested.
- The Minor Children may have telephone/audio-video access to the Parents at reasonable times and for a reasonable duration.
- Each Parent may have telephone/audio-video access to the Minor Children at reasonable times and for a reasonable duration.
- Neither Parent nor any other third party may listen to or monitor the calls.
- The Parents will communicate directly with each other on matters concerning the Minor Children and may not use the Minor Children as messengers between them.
- Neither Parent will make, nor allow others to make, negative comments about the other Parent or the other Parent’s past or present relationships, family, or friends within hearing distance of the Minor Children.
- Each Parent is enjoined and restrained from saying anything or doing anything, which might tend to alienate the affection of the Minor Children for the other Parent or allowing any third person to do so.
- Both Parents are enjoined and restrained from doing anything, and permitting any third person from doing so, that would be detrimental to the health, safety, morals, or welfare of the Minor Children.
- The Minor Children will not be exposed to secondhand smoke, including but not limited to cigarettes, marijuana, hookah, or vaping. The Minor Children will not be exposed to any form of secondhand smoke while in the home or car of either Parent.
- The terms and conditions of this order may be added to or changed as the needs of the children and Parents change. Such changes will be in writing, dated and signed by both Parents; each Parent will retain a copy.
