RE: ISSUANCE OF PARKING PERMIT

My name is Insert Name, a resident of Insert Address. I completed the purchase of my property on 04/13/2021. I was given a resale package that contained the Parking and Garage Rules and Regulations effective November 2017. Rule 4 of the Parking and Garage Rules and Regulations states in part as follows: “Residents who believe they may require a street parking permit must submit a request in writing to Association Management and provide proof of the conditions requiring such a permit, e.g. the Resident’s vehicle does not fit in their garage due to the size of the vehicle, the Resident owns three (3) vehicles and is using their garage to park two (2) of their vehicles.”

Pursuant to the provision above, I applied to the Desert Bloom Home Owners’ Association for a parking permit on 05/26/2021. The reason I wanted the permit was because my brand-new Tacoma pickup could not fit in my garage. The association replied with an email that contained the Revised Parking Rules adopted on February 26, 2019 which stated in particular that no street permits would be granted after May 1, 2019. 

I would like to submit that the Revised Parking Rules adopted on February 26, 2019 were not included in the resale package I was given before completing the purchase of my property. In deciding whether or not to purchase the property, I considered all conditions and restrictions based on the resale package that was availed to me. The resale package did not include the Revised Parking Rules adopted on February 26, 2019. It is therefore untenable for the association to refer me to rules that weren’t availed to me in the resale package. The association ought to issue me with a street parking permit pursuant to Rule 4 of the Parking and Garage Rules and Regulations effective November 2017.

As a result of the association’s failure to issue me with a street parking permit, I have suffered and continue to suffer financial damage. I have to move into my property with my Tacoma pickup. Even so, I respect and wish to continue to abide by the Parking and Garage Rules and Regulations effective November 2017, contained in the resale package. I will only move in when issued with a street parking permit by the association. Since the association has made it difficult for me to move into my property with my pickup truck, I have paid and continue to pay monthly rent in the sum of $1,613.00 from the month of May. 

I still believe that we can amicably come to a resolution of this matter. The association should issue me with a street parking permit as soon as possible so I can fully enjoy the benefits of my property.

This letter will act as a final chance for the association to issue me with a street parking permit before I pursue legal action. At this time, I am not taking any legal action as I hope we can resolve this matter without authoritative involvement. I am not under any circumstances, however, waiving any legal rights I have presently, or future remedies against the association by sending this letter.
