INTERIOR AND EXTERIOR DESIGN CONTRACT

This Interior and Exterior Design Contract being entered into on ______________(enter effective date) by and between Global Architects & Associates having an address at GT Road Dina, Punjab, Pakistan.(hereinafter the “Service Provider”) and  Tanveer Ahmed Chaudhary( Attorney of Chaudhary Imran) having an address at Sidh Taj Pur Alia P/O Jalochak, Tehsil Dina District Jhelum, Punjab, Pakistan(hereinafter “Client”)

WHEREAS, the Designer is proficient in providing architectural exterior designing and interior designing. The Designer will provide the following services: design which includes (re-rendering of exterior elevation), door designs, light design (ceiling lights, rope light, wall-lights and exterior wall rights), garden, color schemes & wallpapers, and provide full consultancy and interior work.

WHEREAS, the Client has expressed an interest in exterior and interior design services, and in compensation for the services provided to the Client, the Client will provide a valuable consideration of Three Hundred Thousands Rupees 300,000/=

 

The Parties hereby agree to accept the following as terms pursuant to this interior and exterior design contract:

  • Description of the Services

The Service of consultation and designing should be provided by the Designer is elaborated as below:-

  • The services include the exterior and interior of the above mentioned house.
  • Exterior: (Stage One)
  • Designs which Include re-render of exterior, 3D designing, stone and tile selection work designs, colour scheme;
  • The designs of the general arrangement and components of all of the outside surface of a building, structure or object, including building materials and the type and style of all windows, doors & main gate, lights.
  • Includes the Gardens in the exterior of the house and the 3D designs & working drawings of landscaping of the gardens;
  • Also includes, the boundary walls colour scheme & Designs or any stone & tile work designing of the house along with the driveway tile Selection colour scheme.
  •  Along with all exterior floors designing and material selections and safety fences of the balcony and outer stairs.
  • House main entrance doors front and back should be completed at first stage due to safety precautions of the materials “As decided between both parties on telephonic conversation”.
  • Interior Work: (stage 2)

The Interior Decorator shall depending on project requirements provide some or all of the following services (“Services”) to the Client in accordance with the terms and conditions of this Agreement:  Communication (email/phone calls, etc.) regarding the activities below are included as part of defined “services” payable by the client.

  • Complimentary phone consultation.
  • Conceptual Design Consultation –visit includes walk through of site, preliminary room sketch, and in-depth discussion to ascertain style options, budget and time frame estimates and other project needs. 
  • Design Development /Presentation – Complete measurements and take inventory.  Finalize and present design options/recommendations and requirements.
  • Provide layout with furnishings, color schemes, interior finishes, wall, floor, window and lighting treatments etc, as required.
  • Create and oversee a project plan to include acquiring products, referring contractors, coordinating deliveries and installations, arranging furnishings and accessories, etc.
  • Conduct periodic quality reviews.
  1. Payment schedule

The payment will be made advance at two stages given as below:

  • At the signing of the contract the advance amount of one hundred thousand PKR will be provided by Client along with the starting work on the exterior (stage one) by Designer.
  • After the completion of the Exterior stage 1 if the work done is satisfactory, the sum of one hundred thousand rupees will be paid by the Client to the Designer.
  • The sum of remaining will be paid by the Client to Designer at the finishing of the work on the satisfaction of the work done as mentioned above.
  • If the Designer fails to fulfill the work as per the satisfaction of the Client, the Designer is liable to pay back the given advance sum by the Client and also liable to pay all type of legal proceeding cost for recoveries.
  1. Obligations of the Service Provider
  1. The Global Architects and Associates will make 5 pre-visits to the said site of the Chaudhary Imran House situated at the village Sidh Taj Pur Alia Tehsil Dina District Jhelum, Punjab, Pakistan.
  2. All the designs made by the Global Architects & Associates should be implemented after the prior approval of the Client.
  3. Global Architects and Associates will complete its work with the complete satisfaction of Client.
  4. Global Architects and Associates will guide to construction expert’s guidelines of the work during the visits of the site.
  5. Global Architects & Associates will provide all its best to the man force/Labor working at the site under the supervision of Client for the full fledge implementation of the Designs/material provided.
  6. At any stage or any of the important discussion the Global Architects & Associates will a schedule time via whatsapp or any other online network services with the Client.
  7. Global Architects &Associates shall provide receipts for the payment through email or Whatsapp to the Client when payment is made.
  8. If Global Architects & Associates failed to provide the abovementioned services, it will be liable to pay back the paid amount along with the legal proceeding and recovery fee if any.
  • Obligations of the Client
  1. Client will assure its assistance where needed to the Global Architects & Associates.
  2. The First payment paid at signing of the contract in advance 100k before exterior work starts.
  3. Second payment paid as stage 2 which is interior work also paid as advance before the interior work start.
  4. Third and last payment of 100 k is paid upon completion of the interior work. If Global Architects & Associates fails to complete the work, it will be liable to pay all legal costs for recovery to Client.
  • Confidentiality

Global Architects and Associates as well all individuals representing the Global Architects &Associates shall not under any circumstances divulge or communicate any client information which can be reasonably considered private or confidential. Violation of this confidentiality clause shall be grounds for legal action against the offending party.

  1. Indemnification

 

The Client agrees to hold the Global Architects and Associates harmless in the instance of injury, loss or damages beyond the Service Provider’s control during this Contract term.

  • Force Majeure

In the event of an act of god or an occurrence out of the Parties’ control takes place prohibiting this contract’s fulfillment, the parties will be responsible for notifying one another in a timely manner.

Upon notification measures shall be taken to allow this contract to be completed including changes to the agreement end date as well as the allowance of another Global Architects & Associates to complete portions unable to be completed by the Global Architects.

  • Jurisdiction

This Contract shall be judged in accordance with the laws of Pakistan.

  • Entire Agreement

This contract in its entirety shall serve as the whole agreement between the Parties. It shall supersede any and all previous agreements whether verbal or written. This agreement shall be binding on all parties.

  • Surviving Agreement

If any terms or conditions set forth in this contract are found to be invalid or unenforceable, the parties shall replace that term with one of those close similarities. The replacing of any term or condition as mentioned above shall not void or terminate this contract under any grounds.

Additionally, failure by either party to uphold or enforce any aspect of this contract shall not constitute a waiver of any other aspect of the contract, and the contract shall remain in full effect.
