IMAGE AGREEMENT 

 

This Joint Venture Agreement is made and effective on this day of , 20

BETWEEN 

GOLD HOMES (the “Builder”)

-AND-

ANOMALY DRAFTING AND DESIGN (the “Designer”)

FEATURED STANDARD PLANS: THE MAISLEY, THE BENJAMIN, AND THE XAVIER

 

This agreement will outline this joint venture between both parties. 

All standard plan images issued by the Designer to the Builder are exclusive to the Builder’s website only. Neither party is permitted to distribute shared images on other forms of physical media: newspaper, brochures, email campaigns, posters, billboards, and signage without agreeing with the other. 

All standard plan images issued by the Designer for the Builder’s media platform must provide a direct communication link to back to Anomaly Drafting and Design. Conversely, all shared images displayed on the Designer’s website will link back to Gold Homes

If one party chooses to use a physical form of media that will contain any shared images, both parties must agree on the display of its content. For example, brochures or newspaper ads will be a joint decision by both parties on selecting the images and how the images are to be presented. 

The Builder cannot alter any images issued from the Designer without granted permission. The Designer will alter any of the featured images at the Builder’s direction for the website. 

The Builder reserves the right to select which standard plans will be featured. At the end of the term of the agreement, the Builder must return the rights to the Designer. 

At the end of the term agreement, the Builder will have an opportunity to re-sign with the Designer and select different floor plans for the joint website promotion. Or extend the contract on the currently selected images, or add more to the existing contract.  

To eliminate any conflict of interest, images used for joint venture promotion are exclusive to the partnership between the Designer and the Builder. However, in the event the Designer’s client wishes to build a promoted image without the involvement with the Builder, then the Designer will pay the Builder $1000.00 from the total design fee for services towards the Builder

Either party cannot conduct price adjustments to standard plans at any time

The website’s standard plans will have a base price of $3000.00. The Designer will inform the client/homeowner of the pricing structure as per desired design changes. In exchange, the Designer will give the Builder a referral fee of $500.00 for every signed contract. The referral fee will be delivered at the time of the building permit application submission

 

I have read this proposal, and I have agreed to the terms and conditions contained therein, the same having been explained to me to my understanding.
