EMPLOYMENT CONTRACT
This contract (“this Agreement”) is entered into by and between [NAME] of address [ADDRESS] (“Employer”) and [NAME] of address [ADDRESS] (“employee”) on [DATE] (“Effective date”).
NOW, THEREFORE, in consideration of the premises, and of the mutual promises and undertakings herein contained, the parties, intending to be legally bound, do agree as follows:
- APPOINTMENT
The EMPLOYEE hereby accepts the appointment and is appointed as a Caregiver
- DURATION
- This agreement will become affective as from the effective date and it will continue for an indefinite period until it has been cancelled in terms hereof.
- There shall be a maximum of 2 (two) written warnings in instances that involve misconduct.
- THE EMPLOYEE’S DUTIES
- The core of the EMPLOYEE’s duties towards the EMPLOYER is a duty to obey all lawful and reasonable order and to perform such work as she / he is directed to perform which falls within his / her vocational ability.
- Without limiting the aforesaid duties, the EMPLOYEE is obliged to strictly comply with the provision of this agreement, may not misappropriate the EMPLOYER’s property, keep all information entrusted to him / her confidential and have to adhere to the general Code of Conduct that governs all relations with co-employees and clients.
- REMUNERATION
The EMPLOYEE will be entitled to the following remuneration:
- Employees will be paid $100 per day/24 hours.
- Employee will be paid bi-monthly on dates 6th and 21st of every month.
- ANTI HARASMENT CLAUSE
The employer recognizes the rights of employees to work in an environment free of harassment. The Company shall not condone acts of harassment based on but not limited to race, religion, sex, national origin, color or disability.
- TERMINATION
- Either Party to this Agreement may terminate this Agreement upon a written notice of termination to the other Party. Unless otherwise mutually agreed to in writing, upon the termination of this Agreement, any arrangement for services then in effect will immediately terminate.
- The employer may terminate this contract if the employee contravenes this agreement.
- Any act of incompetence, insubordination, harassment or any criminal act shall lead to immediate termination and/ or taking of legal action if mediation id esteemed not an efficient way of dealing with the issue at hand.
- DISPUTES
Any and all disputes that arise as a result of this agreement shall be mediated and the rules shall be set by the parties without disregard of the laws of the state of California
- GOVERNING LAWS
This Agreement shall be construed and governed in accordance with the laws of California.
