Dear,
I refer to the incident that occurred on December 4th, 2020 at around 10.14 pm. On this day, I visited your store number #2215 which is the closest McDonalds to my house. I placed an order asking for a holiday pie. When I got to the first window to pay for the placed order, the employee at the service counter informed me that there were no holiday pies. I had to change my order and instead ordered two chocolate chip cookies. The employee rang up my order, swiped my card and told me I would get my receipt at the next window. As I got to that window to pick up my receipt and order, no one was there to attend to my order for about 20-30 minutes despite a line full of cars behind me. As I was waiting, I could hear people talking and moving around in the back of the store who I believe were employees of the store.
Suddenly I heard a female voice saying out loud ‘‘y’all stop looking at me, y’all irritating me’’ then a female approached the window asking me what my order was with an attitude. I told the lady to look on the screen for my order. She responded back by telling me that it was not on the screen yet I had already ordered and paid for it. The guy at the previous window had told me earlier that I would get my receipt at that window. She then proceeded to argue with me at the window then suddenly threw the entire bag of food at my face into my car. At that point I requested to speak to a manager only to find out later that the person who threw the food in my car was the manager for the night.
Since I was assaulted by the employee and was not receiving my money back, I called the police to resolve and document the incident. The employee admitted to throwing the food at me in my car to the police on body camera and also documented it in the police report.
For this reason, I hold you responsible for proceeding in acts that have directly violated my rights. Unless the aforementioned issues are resolved, this letter formally places you on notice of the legal requirements concerning document retention and expect you and all its affiliates to honor such requirements.
You have a legal obligation to maintain and preserve any and all documents, materials, and information, in any form whatsoever, which may be potentially relevant to the subject matter, or discoverable in any potential action arising from this issue.
It is in the best interest of both parties to resolve this matter as soon as possible. If there is no response by ___________________, 20____, then it shall be my right to pursue any and all available legal and equitable remedies, including, but not limited to, instituting formal litigation proceedings against you.
I have attached the necessary evidence of the incident including the police report.
