CAR HIRE AGREEMENT.

This Car-hire Agreement (hereinafter referred to as the “Agreement”) is made and entered on this ____ day of _____ 2021 (the “effective date”), between ShowMi Luxury Rentals, Contact Info www.ShowMiLuxuryRentals.com (hereinafter referred to as the “Company”), and _____________ Address _____________ (herein referred to as the “Client”).

NOW THEREOF, in consideration of the mutual covenants and promises made by the Parties hereto, the Parties covenant and agree as follows:

  • TERM.

The initial term of this Agreement shall be for a period _____ [Hours/Days/Weeks/Months], commencing on the Effective Date herein.

  • SCOPE.
    1. The Client is hiring the following van from the Company for the term specified herein.

 ☐The 2019 White Mercedes Sprinter or

 ☐Both.

  1. The Client shall not be in possession of or use illegal substances and/or drugs while in possession of the van/car during the term of this Agreement.
  • FEES/CHARGES/CANCELLATION/REFUNDS.
      1. The Client shall pay ______ Dollars for the services covered herein, _____ down payment shall be made in advance on the Effective Date herein, and the balance paid ____________________.
      2. The Client can terminate this Agreement by offering a ___ Hour written notice before taking possession of the van/car. If the Client cancels the Agreement less than ___ hours, they shall forfeit the down payment. If the Client cancels the Agreement, after taking possession of the van/car but before the expiry of the term, they shall pay the full fees amount or an estimate as will be negotiated with the Company.
  • LIABILITY.
      1. The Client has, before the Effective Date herein, inspected the car/van and ascertains that it was in perfect working conditions. The Client shall be held responsible for any damage caused to the car/van while in their possession/use, and shall pay for any repairs needed. 
      2. The Company shall not be held liable for any loss of property including but not limited to lost money and valuables, and any injuries sustained by the Client while they are in possession/using the car/van, provided that the loss and/or injuries are not as a result of the Company’s negligence. The Client agrees to indemnify the Company against any and all claims that may arise from the performance of this Agreement.
      3. The Company shall not be held responsible for any illegal drugs and/or illegal substances found on the Client during the term of this Agreement. The Client agrees to defend and indemnify the Company against any and all claims that may arise from the use, abuse, possession, or sale of illegal drugs and/or illegal substances in the van/car.
  • WAIVER.

The waiver by either party of any breach or failure to enforce any of the terms and conditions of this Agreement at any time shall not in any way affect, limit, or waive such party’s right thereafter to enforce and compel strict compliance with every term and condition of this Agreement.  

  • MODIFICATION.

This Agreement contains the entire Agreement between the Parties relating to the subject matter hereof and supersedes any and all prior agreements or understandings, written or oral, between the parties related to the subject matter hereof.  No modification of this Agreement shall be valid unless made in writing and signed by both parties hereto.

  • GOVERNING LAW/JURISDICTION
    1. This Agreement shall be governed by and construed in accordance with the laws of ____________ [State/Country]. Exclusive jurisdiction and venue shall be in _____________ [State/Country].
    2. This Agreement shall be binding upon and inure to the benefit of the Company and the Client and their respective successors and assigns, provided that the Client may not assign any of their obligations under this Agreement without the Company’s prior written consent.  
    3. Each party represents and warrants to the other that such party has acted in good faith, and agrees to continue to so act, in the negotiation, execution, delivery, performance, and any termination of this Agreement.
