RE: SETTLEMENT AMOUNT

I hope you are doing fine. I write this letter regarding settlement in a case that you are helping us
with. You have been representing Jason in his personal injury case, after he suffered a severe
cervical spine injury seven years ago. The insurance company offered to settle the matter for a
million dollars plus. However, it is my view that we need to settle for more.
i. It is the intention of the insurance company to settle for more than one million
dollars
The insurance company indicated their intention to settle for a million dollars plus. According
to my understanding, this statement shows the insurance company’s intention to have the
settlement amount pass one million dollars.
ii. One million dollars is not sufficient
Next, one million dollars would not be enough to sufficiently compensate Jason for his injuries.
If we settle for a million dollars, then you remove your fees (33%) and the Workman’s
Compensation (66%) is deducted, Jason would be left with little funds to compensate him for all
he has been through for the past seven years. Being our friend, you are aware that since the
accident, he has suffered from severe migraines, balance issues, weakness in his arms and neck,
and cognitive issues.
iii. There is proof that Jason suffered a brain injury
I appreciate your advice that it may be hard to prove brain damage. However, Jason has residual
neurological and cognitive problems, which prove that Jason has significant physical and mental
impairments from the injuries he sustained. After taking the MRI/CAT scans, Jason had other
special tests done in cases of brain injuries by a special therapist. The tests revealed that he has a

I have observed Jason having a difficulty in processing information, which shows that the brain
injuries have interfered with his memory. He has a poor memory and does not process
information well. He also has a difficulty in maintaining a conversation. I sometimes have to
repeat the same sentence to him as he may have not processed what he was told the first time.
That’s not just the signs of a typical man trying to block out what his wife is saying. He also
frequently blurts out words anytime during the course of the day or night.
At the moment, he is going to a neurologist for new tests to ascertain any residual damages. He
also needs to go for physical therapy due to the weakness in his arms and neck. His posture is
awful, and he is hunched over all the time. He has therefore not yet healed fully from his injuries.
iv. Jason’s income levels have decreased as a result of the injuries
Jason can no longer make the money used to make before the accident, when he was doing
manual labor. Workman’s Compensation sent him to Access VR to test what profession would
fit him. They made him take some tests and concluded that IT would be good for him. Jason then
went to three different schools to study desktop. He failed the A+ exam several times because he
found it hard to process the information. Also, during his schooling he attended brain training
sessions to help heal his brain.

It has been hard for Jason to find jobs due to his age and the economy. He is currently doing
contractual work in IT on a part-time basis. He has not been able to earn a good income and does
not even close to $50,000 a year. Sufficient compensation would therefore help him get due
compensation for the injuries that interfered with his ability to work.
Having considered the circumstances above, is there a way we can prove Jason’s brain injury
based on his residual neurological and cognitive problems? Also, what is the higher possible
