8 Hour Class Cancellation Policy: PMF Fitness Studio enforces a strict 8 hour class cancellation policy. If you have reserved your place in a PMF Class and fail to cancel 8 hours in advance you will be charged and/or forfeit a session for the class.
Late Arrival Policy: PMF Fitness Studio enforces a strict Late Arrival Policy. If you are more than 5 minutes late for your class you will lose your spot and may incur a Late Cancel Charge and/or forfeit a class session. You must be on time to class to properly stretch and warm-up prior to engaging in a PMF class. No entry into class after 6 minutes.
Dress Code Policy: PMF Fitness Studio wants you to come to class fully prepared for strenuous activity: enclosed running shoes, athletic sports/pants, athletic t-shirt, towel and water bottle. We reserve the right to refuse you entrance into the studio if you are not properly attired.
Membership Cancellation: PMF Fitness Studio membership will remain active every month until you complete a Cancellation form in person at its studio location. A final Membership charge is required and you will have an active membership for 30 days after your final membership charge. DISCLAIER OF LIABILITY: PMF URGES ALL MEMBERS TO OBTAIN A PHYSICAL EXAMINATION FROM THEIR PHYSICIAN PRIOR TO INITIATING ANY EXERCISE PROGRAM. PMF TRAINING PROGRAMS ARE NOT DESIGNED FOR INDIVIDUALS WITH KNOWN HEART DISEASE WITH OR WITHOUT FUNCTIONAL IMPAIRMENT. IN RECOGNITION OF THE POSSIBLE DANGERS CONNECTED WITH ANY PHYSICIAL ACTIVITY, MEMBER HEREBY ACKNOWLEDGES AND VOLUNTARILY WAIVES ANY CASUE OF ACTION OF ANY KIND WAHTSOVER ARISING AS THE RESULT OF SUCH ACTIVITY FROM WHICH ANY LIABILITY MAY OR COULD ACCRUE TO PMF, ITS OFFICERS, AGENTS, EMPLOYEES, INSTRUCTORS OR ASSIGNS, AND AGREE TO RELEASE AND HOLD PMF HARMLESS THEREFROM.
Section 1. Severability. If any part of this Agreement shall be held invalid, that part shall be excluded from this Agreement and the remainder of the Agreement shall remain in full force and effect. Section 2. Jurisdiction. To the full extent permissible by law, for purposes of any dispute arising out this Agreement all parties hereto agree to submit to the sole and exclusive jurisdiction of the State of Ohio, and to the application of Ohio law. Any action hereunder shall be brought in Franklin County, Ohio. Section 3. Entire Agreement. PMF and Member hereby acknowledge that this Agreement, and the attachment hereto, constitute their entire Agreement. It cannot be amended except in a writing executed by both parties.
Section 4. Cancellation. Member may cancel this Agreement at any time within three (3) business after signing, as set forth in the attached Notice of cancellation; and Member may cancel at any other time thereafter for any reason on thirty (30) days advance written notice. In addition, in the event of (a) Member’s death; (b) Member’s disability which leaves Member physically unable to receive the benefits of this Agreement; (c) Member relocates twenty-five miles or more from PMF facility ; or (d) PMF fails to provide a facility to Member or Member’s current residence, upon written notice thereof to PMF, PMF shall refund to Member or Member’s representative that pro-rata portion of fees paid by Member, based on the number of days to which such payment applied, for all days after the occurrence of the foregoing event.
Section 5. Personal Information. All information and material of a personal or private nature that is acquired by PMF from Member, including but not limited to answers to tests or questionnaires, photographs or background information, shall be returned by PMF to Member by regular mail within thirty (30) days after termination of this Agreement.
Section 6. Freeze Policy. For a fee of $ 10.00 per month, Member has the option to freeze his/her minimum of thirty (30) days, up to a maximum of sixty (60) days, up to two times per year, in any twelve (12) month period by providing written notice thereof to PMF.
